Job Description

  • Provide client and supplier/subcontractor support for execution of multiple projects in the United States, Canada, and other locations as necessary
  • Analyze, evaluate, and resolve diverse matters, commercial customers, partners, suppliers, subcontractors, and government agencies
  • Prepare, assert, participate in, and process claim negotiations together with the project management
  • Participate in negotiations with clients, partners, suppliers, and subcontractors, and prepare legally binding documents
  • Identify and assess the primary contractual risks, opportunities and requirement and communicates them within the project team
  • Cooperate with the project management to define the contract strategy
  • Prepare contract concepts and defense strategies
  • Prepare and execute project-related claim opportunities
  • Consult with management and draft official client and/or supplier/subcontractor correspondence in a timely, clear, and professional manner
  • Develop risk mitigation and settlement strategies and negotiate and finalize settlement agreements where necessary
  • Monitor contract conditions and events (duration, consequences, losses), deadlines, milestones and contract-related correspondence and act accordingly
  • Identify claim possibilities and communicate them along with supporting arguments and documentation
  • Undertake the task to justify and provide legal support on other issues as necessary
  • Defend against external claims from clients, partners, suppliers, and subcontractors through the presentation of relevant exonerative facts and documentation
  • Develop project-specific procedures in own area of expertise and reviews other quality procedures that involve contractual issues
  • Conduct legal research and writing; and provide ongoing legal support within territory
  • Develop and provide legal/compliance training to the team, coach team members and work with corporate executives to ensure adherence to corporate policies and guidelines
  • Control all claim-relevant issues and the data administration in the project with aim to control and report progress and events to relevant stakeholders
  • Ability to work within a team to identify and reach optimal project outcomes
  • Comply with internal corporate processes and procedures

Qualifications

  • More than 5 years’ experience in comparable function in industrial projects in the construction industry or similar
  • Significant experience in drafting, negotiating, administering, and closing EP, EPC, and service and maintenance contracts
  • Sound commercial and business knowledge and understanding of project structure

Consistent track record in commercial transactions and /or litigation

  • Excellent negotiation and communication skills
  • Ability to produce quality materials within tight timeframes and simultaneously manage several assignments
  • Ability to define and manage commercial aspects associated with strategy for services delivery
  • Excellent professional and legal written and verbal communication and interpersonal skills
  • Very good problem-solving skills and ability to consider complex interdependent aspects of problems
  • Ability to independently identify and assert claims during project execution
  • Experience in the renewable natural gas, energy-from-waste, or other energy industries
  • Experience operating in a multinational business
  • Cross-cultural competencies
  • Experience in managing projects in multiple states and/or outside of the US (especially in Canada)

Physical Demands:

  • Frequently required to talk or hear, sit, use hands to finger, handle or feel, reach with hands and arms.  The employee must occasionally lift and/or move up to 10 pounds.

Working Conditions:                   

  • Primary environment: ambient room temperatures, lighting and traditional office equipment as found in a typical office environment.  The noise level in the work environment is usually moderate.
